Premises Liability

A property owner can be held responsible for injuries caused by a defect in the property if the owner knew that there was something wrong.  A good example would be in a case we tried a few years ago — our client had leaned against a railing on an elevated porch.  The railing gave way, and she fell to the ground and broke some ribs.  We called as a witness the repair person who had made a repair to the railing, who was ready to testify that he had warned the landlord that the temporary fix that he had made wouldn’t last, and that more work was needed.   There are other cases of property defects where the evidence is that the owner should have known of the defect — that he should have inspected the property, and if he had, he would have seen the problem.  Or that a report was made, but he didn’t read it.
